These Terms and Conditions ("Terms") govern your access to and use of the website https://www.fixkaru.com/ (or applicable domain), Fixkaru's mobile applications, and any doorstep mobile phone diagnostic and repair services offered through them (together, the "Platform"), operated by Fixkaru Technologies, a company incorporated in India under the Companies Act, 2013 ("Fixkaru", "we", "us", or the "Company").
By accessing or using the Platform, placing an order, or availing any repair service through Fixkaru, you ("User", "you") agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Acceptance and Updates to These Terms
1.1 By using the Platform or booking a repair, you confirm that you accept these Terms in full.
1.2 We may update these Terms from time to time by posting the revised version on the Platform. Continued use of the Platform after such changes constitutes your acceptance of the updated Terms. We recommend checking this page periodically.
1.3 We may modify, add, or discontinue any feature of the Platform, or impose usage limits, without prior notice.
2. Who Can Use Fixkaru
2.1 You must be at least 18 years old and legally competent to enter into a contract to use Fixkaru's services on your own behalf.
2.2 If you are booking a repair on behalf of a company, organisation, or another individual, you confirm that you are authorised to do so and that these Terms will bind that entity or individual.
2.3 If the device belongs to a minor, the person booking the service confirms they are the minor's parent/legal guardian, or are otherwise authorised by the device's lawful owner to request the service.
2.4 We may suspend or restrict your access if we determine, at our discretion, that you no longer meet our eligibility requirements, without liability to Fixkaru.
2.5 You are responsible for keeping your device and account secure (encryption, passwords, screen locks, etc.) while using our services, and you bear the risk of any compromise arising from inadequate security on your end.
3. Acceptable Use
You agree not to:
- Use Fixkaru's Platform or services for any unlawful purpose, or in breach of applicable law (including intellectual property law);
- Redistribute, resell, sublicense, or commercially exploit any part of the Platform without our written consent;
- Circumvent security features, remove proprietary notices, or interfere with the integrity or performance of the Platform;
- Post or transmit content that is defamatory, obscene, harassing, discriminatory, infringing, misleading, or otherwise unlawful;
- Impersonate any person or misrepresent your affiliation with Fixkaru or any third party;
- Upload viruses, malware, or code designed to harm the Platform or harvest other users' data;
- Reverse-engineer, decompile, or attempt to extract source code from the Platform or app;
- Scrape, deep-link, or use bots/automated tools to access or copy content from the Platform outside normal use;
- Submit a device you know or suspect to be stolen, counterfeit, or unlawfully obtained;
- Request any repair or modification that would be unlawful or compromise device safety/regulatory compliance;
- Behave abusively, threateningly, or obstructively toward a Fixkaru technician or representative, whether at your doorstep or otherwise, or interfere with a technician's work in a way that creates an unsafe situation.
We may suspend or terminate your access, cancel pending orders, or decline service where we reasonably suspect fraud, misuse, abusive behaviour, or breach of these Terms, or where required for security, technical, legal, or force majeure reasons.
4. Key Terms Used in This Document
- "Device" — the mobile phone, tablet, or similar electronic device you submit to Fixkaru for diagnostics, repair, or related services.
- "Order" — a service request placed via the Fixkaru app, website, WhatsApp, or call centre, and confirmed by Fixkaru.
- "Services" — diagnostics, doorstep or in-store repair, pickup-and-drop, and related services (including sale/installation of spare parts) offered by Fixkaru.
- "Technician" — an independent professional engaged by Fixkaru or its partners to carry out repairs; not an employee or agent of the User.
5. Placing and Confirming an Order
5.1 Orders can be placed through the Fixkaru app, website, WhatsApp, or by phone. An Order is confirmed only once Fixkaru sends a confirmation (slot, indicative charge, technician details) via SMS, WhatsApp, email, or in-app notification.
5.2 A technician will typically run an initial diagnostic and share an estimate before starting chargeable work. Estimates are indicative and may change if further issues are found during the repair.
5.3 We will not carry out chargeable repairs or replace parts until you've approved the estimate — via the app, WhatsApp, a recorded call, or in-person confirmation to the technician. Your approval authorises us to open and work on your device.
5.4 If additional issues are discovered mid-repair that would materially change the scope, cost, or timeline, we will inform you and get your consent before proceeding further or charging more.
5.5 Depending on the issue, service may be completed at your doorstep or may require the device to be taken to a Fixkaru service point; we'll let you know which applies before starting work.
5.6 Promo codes, discounts, and credits are subject to their own specific terms, are non-transferable, cannot be redeemed for cash, and may be modified or withdrawn at our discretion (subject to applicable law). Refunds on orders paid via promotional credit are limited to the amount actually paid in money, unless the promotion states otherwise.
6. Pricing, Payments, and Taxes
6.1 Applicable charges are communicated to you at the time of booking or diagnosis, over the app, WhatsApp, phone, or at a Fixkaru store.
6.2 Quoted charges are based on the information you provide and/or the initial diagnostic, and may be revised if additional issues or services are identified — we'll always get your consent before charging a revised amount.
6.3 All fees are subject to applicable taxes (including GST) unless stated otherwise. Unless specified as exclusive of tax, quoted fees are inclusive of applicable taxes.
6.4 We accept payment via UPI, cards, net banking, cash-on-delivery (where available), and other modes we may notify from time to time. We may require partial or full advance payment (including a diagnostic/visit fee) as a condition of accepting an Order, adjustable against your final bill. We may withhold your device until payment is completed.
6.5 Online payments are processed via RBI-authorised third-party payment gateways. Your use of such gateways is also subject to their own terms and privacy policies. While we choose our payment partners carefully, we are not liable for delays, errors, or unauthorised charges caused by such third parties, except as required by law.
6.6 If your payment fails, is charged back, or is reversed for reasons not attributable to Fixkaru, we may suspend/cancel the order, withhold your device until dues are cleared, and recover reasonable costs incurred as a result.
6.7 Report any double charges or failed transactions to us or your payment provider promptly; verified excess amounts will be refunded or adjusted within a reasonable time.
6.8 An invoice will be issued electronically (email/SMS/WhatsApp/in-app) or physically, per applicable tax law, on completion of service or payment.
6.9 Charges levied by your own bank or card issuer in connection with payment are your responsibility.
7. Accuracy of Platform Information
Information on the Platform is provided for general reference and may not always be fully accurate, complete, or current. We may update Platform content at any time without obligation to notify you, except where doing so would affect a confirmed Order. Nothing here limits any statutory rights you have under consumer protection law.
8. Warranties on the Platform and Services (Disclaimer)
8.1 Except for statutory warranties that cannot be excluded under applicable consumer law, and except for the limited repair/parts warranty described in Section 10, the Platform and Services are provided on an "as is, where is" basis, without warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 We aim to keep the Platform and Services running reliably, but do not guarantee uninterrupted or error-free operation, and are not liable for outages, downtime, or interruptions beyond our reasonable control, subject to Section 12.
9. Your Device and Your Data
9.1 You confirm you are the lawful owner of the device, or are authorised by the lawful owner to request repair services on it.
9.2 Before handing over your device, please: back up your data; remove SIM/memory cards and unnecessary accessories; and disable or share access codes for any security/tracking locks (e.g., Find My Device, screen locks) needed for our technician to diagnose and test the device.
9.3 Repairs may involve our technician accessing data on your device. We do not guarantee preservation of your data, apps, or settings, and — except where loss results from our wilful misconduct — we are not liable for data loss, corruption, or exposure arising from the repair process. We strongly recommend backing up your device before every service.
10. Warranty on Repairs and Parts
10.1 Fixkaru offers a limited warranty on select repairs and parts, as communicated to you at the time of booking ("Warranty").
10.2 If a covered part or repair fails within the Warranty period, notify us promptly and make the device available for inspection. Our sole obligation — and your exclusive remedy — is repair, replacement, or re-performance of the relevant service at no extra charge.
10.3 The Warranty is void if: the device suffers subsequent physical/liquid damage after our service; the device is opened or serviced by anyone other than Fixkaru during the Warranty period; or the device was misused, fitted with non-Fixkaru/counterfeit parts, or used contrary to manufacturer instructions.
10.4 The Warranty does not cover pre-existing issues unrelated to the service performed, data/software issues, or third-party accessories not supplied by Fixkaru.
11. Cancellations and Refunds
11.1 Our cancellation policy: Customer may cancel an Order free of charge at any time before a technician has been assigned to it. Once a technician has been assigned, the booking amount (if any) paid at the time of placing the Order is non-refundable.
11.2 Refunds, where applicable, are limited to amounts actually received by Fixkaru for the relevant Order, and are issued to the original payment method (or another reasonable mode) within a reasonable time.
11.3 Refunds exclude indirect, incidental, or consequential losses, subject to Section 12.
11.4 Cancellation charges, if any, will only be applied as permitted under applicable law, including the Consumer Protection (E-Commerce) Rules, 2020.
12. Limitation of Liability
12.1 Fixkaru is not liable for indirect, special, punitive, or consequential losses (including loss of data, business interruption, or loss of profit), regardless of prior notice of such possibility.
12.2 Except in cases of death or personal injury caused by our negligence or wilful misconduct, our total liability for any claim relating to an Order or Service is capped at the amount (excluding taxes) you actually paid Fixkaru for that specific Service.
13. Indemnity
You agree to indemnify and hold Fixkaru, its officers, employees, and affiliates harmless from third-party claims and direct losses arising from: your breach of these Terms; your device or its data being stolen, counterfeit, or unlawfully obtained; a request that would violate law or third-party rights; or your acts/omissions causing damage to our technician, property, or a third party — provided we promptly notify you, you retain control of the defence, and we cooperate reasonably.
14. Intellectual Property
14.1 All intellectual property in the Platform, app, branding, workflows, and content belongs to Fixkaru or its licensors. These Terms do not transfer any IP rights to you beyond a limited licence to use the Platform for your personal, non-commercial use.
14.2 You may not copy, reverse-engineer, or reuse any part of the Fixkaru app, backend systems, or dashboards without our written consent.
14.3 By submitting reviews, photos, or feedback ("User Content"), you grant Fixkaru a worldwide, royalty-free licence to use, reproduce, and display that content in connection with our Services and marketing, subject to our Privacy Policy.
15. Third-Party Links
Links to third-party websites are provided for convenience only. Fixkaru does not control or endorse such sites and is not responsible for their content or practices.
16. Relationship Between the Parties
Nothing in these Terms creates a partnership, employment, joint venture, or agency relationship between you and Fixkaru.
17. Assignment
You may not assign your rights or obligations under these Terms without our written consent. Fixkaru may assign or transfer these Terms in connection with a merger, acquisition, or restructuring.
18. Governing Law and Dispute Resolution
18.1 These Terms are governed by the laws of India. Both parties submit to the exclusive jurisdiction of the courts of Pune District and Sessions Court falls under jurisdiction of Bombay High Court.
18.2 The parties will first attempt to resolve any dispute amicably through mutual discussion.
18.3 Nothing in this section limits your statutory rights under the Consumer Protection Act, 2019, including your right to approach a consumer dispute redressal forum.
19. Confidentiality
Any confidential or proprietary information you obtain about Fixkaru through your use of the Platform must not be disclosed without our prior written consent.
20. Force Majeure
Fixkaru will not be liable for failure to perform obligations (other than payment obligations) due to events beyond our reasonable control — including natural disasters, war, government restrictions, or telecom/internet outages — and will use reasonable efforts to resume service once such events pass.
21. Mobile App-Specific Terms
21.1 Use of the Fixkaru app is governed by these Terms, along with any in-app notices or policies.
21.2 Where role-based access applies (e.g., for technicians or partner staff), users must not attempt to bypass or impersonate another role.
21.3 Misuse of the app — including falsified entries, forged documents, or payment misappropriation — is treated as a material breach of these Terms.
22. Entire Agreement
These Terms, together with Fixkaru's Privacy Policy and any Warranty policy or service-specific terms shared at the time of booking, form the entire agreement between you and Fixkaru on this subject, superseding any prior agreements.
